Improper Lane Use Causes Indianapolis Head-On Car Accident

Posted Aug 09, 2022 by Matt Boulton

Attorney Matt Boulton has handled a variety of Indianapolis car accident cases for Hoosiers throughout the city. Many times, these crashes are the result of distracted driving and/or improper lane usage, as was the case in a recent head-on collision on Kesslser Boulevard, near the Michigan Road intersection.

To help illustrate how quickly car accidents occur on Marion County’s roadways, we will examine the police report of a former Boulton Law Group client who was seriously injured in a 2-car collision near downtown Indianapolis.

Indianapolis Head-On Car Accident

One of the first steps Matt takes after talking to a potential client is securing an official copy of the Indiana crash report. In this instance, the report was available for review and the details confirmed his client’s (Driver 1) version of events.

According to the investigating IMPD officer’s report, the collision occurred on Kessler Boulevard, approximately 380 feet from the Michigan Road intersection. This specific area of the roadway is curved, as illustrated below in the report diagram:

The crash report narrative provided additional information that explains how the crash occurred:

Driver 2 (Matt’s client) said that he was westbound on Kessler Boulevard when he saw Vehicle 1 swerve as it was coming around the curve eastbound, crossing into his lane of traffic. Our client attempted to avoid the collision by turning right off the road, however, Vehicle 1 collided with the front driver’s side of our client’s car.

In this instance, the driver of Vehicle 1 admitted fault and said that he swerved into the opposite lane and struck our client, almost directly head-on.

The investigating officer noted in the report that our client’s version of events was consistent with the damage to the vehicles, which was estimated to be $25,000 – $50,000 worth of damage and required both vehicles to be towed.

The collision resulted in our client and his passenger receiving injuries that required an ambulance to transport both occupants to a local area hospital. (The driver of Vehicle 1 also sustained injuries that required ambulance transport.)

Hiring an Indianapolis Personal Injury Attorney

Having never been in a serious accident, the occupants of Vehicle 2 were unsure about their next steps. After contacting Matt, they decided it would be in their best interest to hire a professional to handle the insurance company and their personal injury claim(s).

Typically, the first step Matt takes when investigating a new case is to confirm the liability and ensure the insurance company agrees with his findings. In this instance, the insurance company did not disagree with their driver’s version of the events or the findings in the accident report.

Because liability was clear, Matt’s primary focus for this case would be on his clients’ health, recovery, and their right to compensation.

Under Indiana law, accident victims have the right to seek various types of compensation, such as:

  • Medical bills related to the accident, past and future.
  • Pain and suffering
  • Lost wages
  • Loss of earning capacity
  • Property Damage

In this case, Matt’s clients had emergency medical treatment and ongoing appointments to help aid in recovery from their injuries, which also led to time off work.

Once they were released from care, Matt was able to put a value to their claims based on findings in the medical reports, the clients’ level of pain and suffering, as well his knowledge of what insurance companies will pay for head-on collisions that involve serious injuries.

As a result, the insurance company met Matt’s demands and his clients received compensation that exceeded what they would have received without legal representation.
