How to file an Indiana nursing home abuse complaint

According to U.S. News & World Report’s Nursing Home Finder, Indiana has a total of 552 homes throughout our state. Out of this total, a mere 34 facilities were given a ‘Top Performing’ rating.

Having such a small number of ‘top performers’ is a disturbing reality for anyone who has a loved one in an Indiana nursing home. The immediate question that needs asked is, “How do we improve the conditions of Indiana’s nursing homes that are providing poor care?

There are several steps a person can take to help ensure their loved one does not become a victim of nursing home abuse or negligence, but it starts by speaking up when poor care is suspected. This includes filing an official complaint.

Having an experienced nursing home abuse attorney guide you through the process helps uncover any possible liability that may justify a lawsuit on your loved one’s behalf.

For anyone that wishes to attempt filing a complaint on their own, there are a number of options:

1) Visit the ‘Reporting a Complaint About a Health Care Facility’ page on the Indiana State Department of Health’s (ISDH) website and download their complaint form.

The form will ask you to fill in a number of items related to the negligent facility, including your relationship to the resident, a description of concerns, as well as your contact information.

It is important to note that you may also submit the form anonymously. However, the ISDH form states that if you do provide your contact information, they will keep your name confidential.

2) If you do not wish to use the ISDH form, you can also email your concerns: complaints@isdh.in.gov

3) You can also call the ISDH direct with your concerns: 1-800-246-8909

4) To fax the complaint form or a summary of concerns: 317-233-7494

5) Send your written complaint to:

When to File an Indiana Nursing Home Complaint

Anytime poor care, abuse, or negligence is expected, an attorney should be contacted and a complaint should be filed.

In our experience with these cases, we have witnessed several instances of victims not telling their loved ones about abuse out of fear. Sometimes the abused will be threatened or intimidated by staff to ensure their silence.

For this reason it is critical that loved ones look for common signs that may indicate poor care or abuse, including:

  • Bed sores
  • Bruises
  • Change in personality (withdrawn, quiet, emotional, depressed, etc.)
  • Infections
  • Broken bones
  • Unkempt appearance

While some abuse signs are obvious, poor care can also be hard to detect as the abuse causes subtle or internal injury.
