Indiana Delivery Person Dog Bite Injury Claim

Posted Jan 17, 2022 by Matt Boulton

In today’s world, we have seen a large increase in the number of delivery companies and persons that offer ‘to-your-door’ service. Whether it’s a large company like Amazon, or a local Mom & Pop shop, there are a number of risks their delivery drivers face.

And while a car accident is near the top of the list of concerns for delivery drivers, there is also a less talked about danger that can have serious implications: Dog Bites.

Attorney Matt Boulton has investigated and handled a number of Indiana dog bite cases, including those involving Hoosiers who were bitten by an animal while they were delivering goods to a home. In fact, many of the dog bites that Matt handles on behalf of his clients are the result of a dog not being properly restrained on the owner’s property.

In this blog, we are going to take a closer look at a case Matt handled that involved a pizza delivery person being bitten by a Pitbull that was unrestrained at the time our client approached the defendant’s residence.

Dog Bite Incident Report

After being contacted by the victim, Matt’s first step in the investigation was to secure an official copy of the Hendricks County Animal Control Bite Report, located in Danville, Indiana.

The official report is used to confirm our client’s recollection of the incident as well as evidence to be used in their case against the defending insurance company.

According to the animal control report, the dog bite happened as described by our client:

Victim was delivering a pizza to the residence on Saturday around 2 PM. Delivery person stated that the owner of the residence opened the door and a tan and white American Pitbull Terrier came out of the home and grabbed ahold of her right wrist and forearm. The victim stated that the dog did not break skin but that she did have some bruising on her wrist and forearm, and her neck was hurting as well. The officer proceeded to the home address and made contact with the dog’s owner. The owner stated that she knew of the incident and that it was just an accident. She stated that they usually put the dog in his cage when someone comes over because he is protective but did not this time and the dog got past them at the door. She stated that they were able to get the dog and take it back inside and it never left their property. She was able to provide proof of current rabies vaccinations as well. Since the bite did not break skin, the officer did not quarantine the dog or do a BOH.

While our client did sustain injuries, she was luckily able to avoid what could have been a more serious attack, largely in part to the owners being within close proximity of the animal at the time of the incident.

Delivery Driver Dog Bite Injury Claim

Matt was able to file a claim against the homeowner’s insurance company and prepare a demand package that outlined our client’s damages and an estimated case value based on previous dog bite cases that he has settled or taken to trial.

Because liability was established early in this case, the chances of our client having to go to trial were practically zero. Avoiding trial helps to wrap up a case in a much more expedient manner.

Matt was able to secure a recovery that met his client’s expectations.

Delivery Driver Dog Bite Injuries

Because many delivery drivers are caught by surprise during a dog attack, there are a number of injury types that may result in the need for legal assistance, including:

  • Puncture wounds and lacerations
  • Broken bones
  • Infection
  • Rabies
  • Soft-tissue injuries, e.g., bruising

No matter the type of injury, it is important to locate a valid, up-to-date record of the dog to help ensure it is current on its vaccinations. Your attorney should be able to locate these records as well as determine whether or not the animal has any prior history of aggression.
